OSHA Forklift Inspection Requirements: The 1910.178 Daily Examination

What 29 CFR 1910.178 actually requires — examination before each shift, immediate removal from service for defects, the surprising fact that OSHA never requires a written record, what the pre-operation and operational checks cover, operator certification, and how the rule changes on construction sites.

OSHA requires every powered industrial truck to be examined before it goes into service, at least daily — and after each shift where trucks run round-the-clock. Any condition adversely affecting safety keeps the truck out of service, and defects must be immediately reported and corrected. What OSHA does not require is a written record of that examination — a nuance that surprises most fleet managers, and one that almost nobody should act on, because the paper (or the app) is what proves the checks happened when a dealer, insurer, or OSHA inspector comes asking.

This guide covers federal OSHA. State plans such as Cal/OSHA run their own powered industrial truck rules and can be stricter than 1910.178 — if you operate or inspect fleets in a state-plan state, check the state text too.

The rule: 1910.178(q)(7)

The daily examination requirement sits in the maintenance paragraph of 29 CFR 1910.178, and the text is short enough to quote in full:

"Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected." — 1910.178(q)(7)

Four obligations in four sentences: examine before service, hold the truck if the exam finds a safety problem, repeat at least daily (per shift for 24-hour operations), and report and correct defects immediately.

Two companion clauses put teeth on the removal side:

The practical consequence: a failed morning check is not a note for the maintenance backlog. The truck is tagged out then and there, and it stays out until someone authorized fixes it. That is the sequence an OSHA inspector reconstructs after an incident — was the defect found, was the truck pulled, who repaired it, and when did it go back into service.

OSHA doesn't require the check in writing. Document it anyway.

Here is the part of 1910.178 that catches people out: the daily examination must happen, but OSHA never requires it to be written down. The agency has confirmed this twice in interpretation letters. A February 2000 letter states plainly that "the standard does not require documentation of a powered industrial truck examination," and that record retention is at the employer's discretion. A May 2000 letter, responding to an employer who sent in their checklist, repeats that "there is no OSHA requirement that the examination be recorded in writing on a checklist" — while noting the employer is well within its rights to require one as a practice beyond OSHA's minimum.

So why does essentially every serious fleet document the check anyway?

  • Proof. An examination with no record is indistinguishable from no examination. If OSHA investigates an incident, a signed (or logged) pre-shift check is the only evidence the exam happened before the truck went out.
  • Completeness. A checklist is what guarantees the operator actually covered forks, chains, brakes, and horn on a cold Monday morning — not just walked past the truck.
  • The defect trail. (q)(7) requires defects to be "immediately reported and corrected." A reporting requirement with no written trail is hard to demonstrate; OSHA's own eTool says problems found during the check "should be recorded on a log and reported to a supervisor."
  • Everyone downstream expects it. Dealers scheduling planned maintenance, insurers pricing liability cover, and lawyers on either side of an injury claim all ask for the daily check records first. "OSHA didn't make us" is technically true and commercially useless.

What the daily examination covers

1910.178 says examine; it doesn't itemize. The itemized version comes from OSHA's Powered Industrial Trucks eTool, which structures the exam in two phases: a pre-operation check with the key off, then an operational check with the engine running. A truck fails into removal from service at either phase.

Pre-operation (key off). Fluid levels; leaks, cracks, or visible defects in hydraulic hoses and mast chains (check chain tension with a stick — never put hands inside the mast); tire condition and pressure; fork condition including the top clip retaining pin and heel; load backrest extension; finger guards; safety decals and the nameplate; the operator manual; the operator compartment; and all safety devices, including the seat belt.

Operational (key on). Accelerator linkage, inch control if equipped, brakes, steering, drive control forward and reverse, tilt control forward and back, hoist and lowering control, attachment control, horn, lights, back-up alarm if equipped, and the hour meter. Unusual noises or vibrations get reported immediately.

On top of the general list, the eTool adds fuel-type-specific items:

OSHA also publishes two sample daily checklists, developed with the Industrial Truck Association: one for internal-combustion trucks (gas, LPG, diesel) with "Engine Off" and "Engine On" sections, and one for electric trucks with "Motor Off" and "Motor On" sections, both headed "Safety and Operational Checks (Prior to Each Shift)." OSHA's own caveat applies: the lists are a guide only, not a substitute for the standard, and each truck type is unique enough that the checklist should be modified to match. Operator certification and the three-year evaluation

Inspection of the truck is half the standard; the operator side lives in 1910.178(l), and it is where "forklift certification" actually comes from. There is no government-issued forklift license. Under 1910.178(l)(6), the employer certifies that each operator has been trained and evaluated, and the certification must record four things: the operator's name, the training date, the evaluation date, and the identity of the person who did the training or evaluation.

Two ongoing obligations follow:

  • The triennial evaluation. 1910.178(l)(4)(iii) requires an evaluation of each operator's performance at least once every three years.
  • Refresher training under (l)(4)(ii), triggered by any of five events: the operator is observed operating unsafely; the operator is involved in an accident or near-miss; an evaluation reveals unsafe operation; the operator is assigned to a different type of truck; or a workplace condition changes in a way that could affect safe operation.

Note the fourth trigger. An operator certified on a sit-down counterbalance truck who gets moved to a reach truck or an order picker needs training on the new type — the certification is per truck type, not a blanket "forklift card."

Construction sites: 1926.602, not 1910.178

On construction sites, forklifts fall under 29 CFR 1926.602 (material handling equipment) rather than 1910.178. The construction rule works by reference: 1926.602(c)(1)(vi) requires all industrial trucks in use to meet the ANSI B56.1-1969 requirements for design, construction, stability, inspection, testing, maintenance, and operation — so the daily examination obligation arrives via the consensus standard rather than an OSHA-drafted clause. For training, 1926.602(d) simply makes the construction requirements identical to 1910.178(l).

On the consensus standard itself: 1910.178(a)(2) incorporates ANSI B56.1-1969 by reference as the design and construction baseline for new trucks. The B56 committee has moved on considerably since — it is now administered by the Industrial Truck Standards Development Foundation, and the current edition is ANSI/ITSDF B56.1-2020 — but the legally incorporated edition in both OSHA rules remains the 1969 text.

Seat belts: no clause, still enforced

Search 1910.178 for "seat belt" and you'll find almost nothing — because ANSI B56.1-1969 predates operator restraints, the standard OSHA built on it has no use requirement. That gap does not mean seat belts are optional. Under its October 1996 enforcement memorandum, OSHA enforces seat belt use on equipped trucks through Section 5(a)(1) of the OSH Act — the General Duty Clause — and flagged possible 5(a)(1) citations where an employer ignored a manufacturer's restraint retrofit program. A 2004 interpretation reaffirmed the policy: operators of trucks equipped with restraints must use them, every time. The same letter points out that 1910.178(q)(6) prohibits removing seat belts from trucks, since that clause bars eliminating parts the manufacturer provided. This is why the eTool's pre-operation check includes the seat belt among the safety devices: an equipped-but-unbelted operator is a citable condition even without a dedicated clause.

For dealers and service companies inspecting customer fleets

If you're a material-handling dealer or an independent service company, the economics of 1910.178 look different: your customers own the daily examination, but you own everything that makes it defensible — the planned maintenance visits, the repair records behind every (p)(1) tag-out, and increasingly the checklist program itself, because customers ask their service provider to "just handle compliance."

At fleet scale that becomes a records problem before it becomes a wrench problem.
